SoundKeeps (“SoundKeeps,” “we,” “us,” or “our”) operates the website soundkeeps.com and provides a personalised custom-song gift service. Please read them carefully — by placing an order or using our website, you agree to be bound by these Terms.
1. Definitions
- “Service” — the personalised custom-song service and related products and add-ons offered by SoundKeeps.
- “Song” — the original, made-to-order musical work we create from the details you provide.
- “Content” — the names, stories, photos, and information you submit to us.
2. The Service
Based on the details you provide, our team writes and produces an original song crafted specifically for you, and — where selected — related keepsakes and add-ons. Each Song is a bespoke creative work. Creative interpretation is inherently subjective, and while we work hard to delight you, results may vary.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.
4. Orders, pricing & payment
Prices are displayed at checkout in US dollars and may change over time. Your order is confirmed once payment is received and we send an order confirmation. Promotional discounts are applied at checkout and may not be combined unless stated. You are responsible for providing an accurate email and, for physical items, an accurate shipping address.
5. How your Song is created
Our Songs are produced by our team using a professional, AI-assisted music workflow combined with human songwriting, editing, and quality review. This is how we deliver studio-quality results quickly and affordably. By ordering, you acknowledge and accept that AI-assisted tools form part of our production process.
6. Licence & ownership
Your Song is created for your personal, non-commercial use — to gift, play, and share privately with friends and family. You receive a personal-use licence to the delivered recording. We do not guarantee exclusive copyright ownership or registration, and commercial use (including broadcast, advertising, resale, synchronisation, or monetised streaming) is not included. If you require broader or commercial rights, contact us before ordering.
7. Your Content & responsibilities
You are responsible for the accuracy and lawfulness of the Content you submit. By submitting it, you represent and warrant that you have the right to share it and that it does not infringe any third party’s rights or contain unlawful, defamatory, hateful, or infringing material. You grant us a limited licence to use your Content solely to create and deliver your order. We reserve the right to decline or cancel any order that violates these Terms, with a refund of amounts paid for the cancelled item.
8. Revisions & delivery
Standard delivery is 3–7 days by private link (rush options may be available at checkout). Revision and refund terms are set out in our Refund & Guarantee Policy, which forms part of these Terms.
9. Intellectual property
All website content, branding, samples, and materials on our website are owned by SoundKeeps or its licensors and may not be copied, reproduced, or reused without our written permission.
10. Disclaimers
The Service and website are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, SoundKeeps’ total liability for any claim arising out of or relating to the Service or these Terms is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
12. Governing law & disputes
These Terms are governed by the laws applicable at SoundKeeps’ principal place of business, without regard to conflict-of-law rules. We encourage you to contact us first so we can resolve any concern directly and fairly.
13. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
